Terms of Service

1. Who We Are and Acceptance of Terms

Cycling in Slovenia ("the Platform", "we", "us") is operated by OFF TRAIL, Grega Cuderman s.p., Pilovova ulica 8, 1000 Ljubljana, Slovenia, registration no. 7536330000, tax no. 38530619, email info@cyclinginslovenia.com.

By accessing or using the Platform — including creating an account, downloading routes, or booking a tour — you agree to these Terms. If you do not agree, please do not use the Platform.

These Terms consist of two parts: Part A applies to everyone using the Platform; Part B additionally applies when you book a tour, experience, bike rental, or accommodation through us.

Part A — Use of the Platform

2. Important Safety Disclaimer — Read Carefully

Cycling is a physical activity that carries inherent risk of injury, accident, and death. By using any route information, GPX file, or recommendation provided on this Platform, you acknowledge and accept these risks.

All routes on this Platform, including routes created by other users, are provided for informational purposes only. They are not a substitute for proper navigation tools, local knowledge, or professional guidance. Route information may be inaccurate, outdated, or incomplete. Road conditions, trail status, closures, and terrain can change without notice. Except where expressly stated for booked tours (Part B), we do not verify, inspect, or maintain routes listed on the Platform.

You are solely responsible for your own safety when cycling, including assessing your fitness, carrying appropriate equipment, checking current conditions before departure, and complying with all applicable laws and regulations.

3. GPX Downloads

GPX files are provided as a convenience and may contain errors. You accept full responsibility for how you use downloaded GPX data. A GPX file is not a guarantee of route safety or feasibility. Always carry alternative navigation as backup.

4. User Accounts

You must provide accurate information when creating an account and keep your credentials secure. You must be at least 16 years old to create an account. You may delete your account at any time in settings; your personal data will then be handled in accordance with our Privacy Policy.

5. User-Generated Routes

When you publish a route on the Platform, you grant us a non-exclusive, royalty-free licence to display and distribute it to other users. You represent that your route does not infringe third-party rights and complies with applicable laws, including lawful use of private land and public roads. You are solely responsible for the accuracy and safety of routes you create. We do not review or verify user-submitted routes and may remove any route at our discretion.

6. Prohibited Uses

You may not use the Platform to:

  • Post false, misleading, or dangerous route information
  • Harass other users
  • Attempt unauthorised access to any part of the Platform
  • Scrape or systematically extract data without permission
  • Violate applicable laws or regulations

7. Intellectual Property

The Platform's design, text, photography, and original content are owned by Cycling in Slovenia. You may not reproduce, redistribute, or create derivative works without prior written permission.

Part B — Tour and Service Bookings

8. Scope

Part B applies when you book any paid service through the Platform or our booking pages, including multi-day self-guided tours (e.g. the Julian Alps Cycling Escape), day experiences, custom tours, bike rentals, and accommodation arrangements ("Services"). The specific description, price, dates, and inclusions on the relevant booking page form part of your contract with us.

Where a booking combines accommodation with other travel services (such as luggage transfer and rail travel), it may constitute a package under Directive (EU) 2015/2302 and the Slovenian Consumer Protection Act. In that case, you benefit from all EU rights applying to packages, and we are responsible for the proper performance of the package as a whole. 9. Booking and Payment

  1. A booking is submitted by completing the checkout and paying the deposit shown (typically 30% of the tour price). The contract is concluded when we send your booking confirmation by email.
  2. The remaining balance is due 14 days before departure. We will send a payment link; if the balance is not paid by the due date despite a reminder, we may cancel the booking and retain the deposit.
  3. Bookings made within 14 days of departure must be paid in full at checkout.
  4. Payments are processed securely by Stripe. Prices are in EUR and include VAT where applicable.

10. Cancellation by You

  • 21 or more days before departure: free cancellation — full refund of all payments.
  • 20 to 8 days before departure: the deposit (30%) is retained; any balance paid is refunded.
  • 7 days or fewer before departure, or no-show: no refund.

To cancel, email info@cyclinginslovenia.com. The date of receipt of your email counts. You may transfer your booking to another person who meets the tour requirements by notifying us at least 7 days before departure; a reasonable transfer fee may apply for costs actually incurred. Because the Services are leisure services with a specific date or period of performance, the statutory 14-day right of withdrawal for online purchases does not apply (Art. 16(l) of Directive 2011/83/EU). Our cancellation terms above apply instead.

11. Cancellation and Changes by Us

  1. We may cancel a departure due to insufficient bookings no later than [7] days before departure, or at any time due to unavoidable and extraordinary circumstances (e.g. severe weather making the route unsafe, natural disaster, official restrictions). In either case you receive a full refund of all payments, or, if you prefer, a transfer to another departure.
  2. We may make insignificant changes to the itinerary (e.g. an alternative hotel of the same category, minor route adjustments) where necessary; we will inform you as soon as possible.
  3. If a significant change is unavoidable (e.g. a different region, a major reduction of included services), you may accept the change or cancel with a full refund.
  4. We are not liable for additional costs you incur (e.g. travel to the start location) beyond the refund, except where required by mandatory law.

12. Your Responsibilities as a Participant

  1. Fitness and ability. You confirm that you have the fitness and cycling ability required for the tour as described (distances, elevation, and difficulty are stated on the tour page). If in doubt, contact us before booking.
  2. Equipment. You must bring or rent a roadworthy bike suitable for the route, wear a helmet at all times while riding, and carry basic spares. Rental bikes arranged through our partners are subject to the partner's rental conditions.
  3. Rules of the road. Tours take place on public roads open to traffic. You must obey Slovenian traffic law at all times.
  4. Self-guided nature. These are self-guided tours: no guide accompanies you. You are responsible for navigation using the provided GPX files and roadbook, and for your own conduct and pace.
  5. Insurance. Personal travel, accident, and health insurance is not included. We strongly recommend travel insurance covering cycling, medical costs, and cancellation. EU visitors should carry their EHIC card.
  6. Accuracy of information. You must provide accurate participant details and inform us of anything relevant to safe participation.

13. Support Services

Where a tour includes on-route support (e.g. pickup service), it is provided as described on the tour page, within reasonable response times and subject to road accessibility. Support is a safety and convenience service, not a guarantee against all eventualities.

14. Third-Party Services

Rail travel is operated by the railway carrier under its conditions of carriage. Accommodation is provided by the named hotels. Bike rentals are provided by rental partners. Where these form part of a package booked with us, we remain responsible for the performance of the package; for stand-alone arrangements (e.g. a bike rental booked separately), the third party's terms apply.

15. Complaints

If something is not right during your tour, contact us immediately at the support number provided in your roadbook so we can fix it on the spot. Complaints after the tour should be sent to info@cyclinginslovenia.com without undue delay. We do not participate in out-of-court consumer dispute resolution before an ADR provider.

16. Limitation of Liability

To the fullest extent permitted by applicable law:

  1. For free Platform features (Part A), we are not liable for any damages arising from your use of the Platform or route information obtained from it, and we expressly disclaim liability for injury, accident, property damage, loss, or death arising from your use of such information.
  2. For booked Services (Part B), our liability for damages other than personal injury is limited to three times the tour price, except in cases of intent or gross negligence. Nothing in these Terms limits liability that cannot be limited under mandatory law, including liability for personal injury caused by our negligence or your rights under the package travel rules.
  3. We are not liable for failures caused by unavoidable and extraordinary circumstances or by your own negligence, including failure to follow the roadbook, riding beyond your ability, or violating traffic law.

17. Changes to These Terms

We may update these Terms. The version in force at the time of your booking applies to that booking. Continued use of the Platform after changes constitutes acceptance for Platform use. We will notify registered users of material changes by email.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Slovenia. Disputes are subject to the jurisdiction of the courts of Slovenia. If you are a consumer residing in another EU country, this does not deprive you of the protection of mandatory consumer law of your country of residence or your right to sue in your country of residence where EU law so provides.
